These Terms of Service (“Terms”) govern your use of the Castelia Card Company website and your purchase of products from Castelia Card Company (“Castelia,” “we,” “us,” or “our”).
By accessing our website, creating an account, placing an order, participating in our rewards program, or otherwise using our services, you agree to these Terms, as well as our Privacy Policy, Shipping Policy, and Return & Refund Policy.
If you do not agree with these Terms, please do not use our website or services.
1. Online Store Terms
Our website is operated using the Shopify ecommerce platform. Purchases made through our website are transactions directly between the customer and Castelia Card Company; Shopify is not the seller of the products offered by Castelia. Shopify similarly identifies the merchant—not Shopify—as responsible for the products, fulfillment, refunds, customer service and regulatory compliance associated with the store.
You may not use our website or products for any unlawful or unauthorized purpose or violate any applicable law while using our services.
2. Products and Collectibles
Castelia Card Company sells trading cards, graded cards, collectibles and related products.
We make reasonable efforts to ensure that product descriptions, photographs, prices, conditions and other listing information are accurate. However, minor errors or omissions may occasionally occur.
Actual colours may vary slightly depending on photography, lighting and the customer’s display.
Unless specifically identified otherwise, photographs of individually listed higher-value raw cards and graded cards are intended to represent the item being sold.
3. Trading Card Condition
Raw trading cards are sold according to the condition stated in the applicable product listing.
Trading cards may naturally contain manufacturing or condition characteristics including centering variations, print lines, surface imperfections, edge wear, corner wear or other imperfections consistent with the disclosed condition.
A stated condition such as Near Mint, Lightly Played or Moderately Played does not constitute a guarantee of a particular third-party grading result.
Customers should review available product photographs and condition information before purchasing.
4. Grading
Castelia Card Company does not guarantee that an ungraded trading card will receive any particular grade from PSA, CGC, BGS or another third-party grading company.
Grading standards are established independently by the applicable grading company and may involve subjective judgment.
For graded cards, the grade and certification information displayed in the product listing are based on the information shown on the applicable grading holder or certification record.
5. Authenticity
Castelia Card Company aims to sell authentic trading cards and collectibles.
If we determine that an item has been incorrectly represented or there is a legitimate authenticity issue, we will review the matter and provide an appropriate resolution consistent with applicable law.
6. Prices
Unless otherwise stated, prices displayed on our Canadian storefront are in Canadian dollars (CAD).
Prices may change at any time without notice before an order is placed.
Applicable taxes, shipping charges, duties or other charges will be displayed or calculated as applicable during checkout.
A pricing error does not obligate Castelia Card Company to complete a transaction at an obviously incorrect price. If an error is discovered after an order is submitted, we may contact the customer to resolve the issue or cancel the affected order and refund any applicable payment.
7. Orders
Submission of an order does not necessarily constitute final acceptance of that order by Castelia Card Company.
We reserve the right to refuse or cancel an order where reasonably necessary, including in circumstances involving suspected fraud, inventory errors, duplicate inventory sales, obvious pricing errors, payment issues, shipping restrictions or other legitimate operational concerns.
If we cancel an order after payment has been collected, the applicable amount will be refunded.
Inventory for collectible trading cards is often limited to one copy of a particular item, and availability cannot always be guaranteed until an order has been processed.
8. Payment
Customers agree to provide current, complete and accurate billing and payment information.
Payment processing may be provided through Shopify Payments or other authorized payment providers offered at checkout.
Castelia Card Company does not independently store complete payment card numbers submitted through Shopify’s secure checkout infrastructure.
9. Shipping
Shipping is governed by our separate Shipping Policy, which forms part of these Terms.
Current Canadian shipping options include eligible free Canada Post Lettermail and tracked Canada Post Expedited Lite. United States shipping is offered through eligible calculated tracked courier services.
Certain products, including graded cards, slabs and selected high-value raw cards, require tracked shipping.
Delivery estimates are estimates and are not guaranteed.
10. Returns, Refunds and Cancellations
All sales are final, except where otherwise required by applicable law or where Castelia Card Company determines that an order qualifies for a remedy under our Return & Refund Policy.
We do not accept returns or exchanges due to change of mind.
Ontario does not provide consumers with a general statutory right to return or exchange ordinary goods, although specific refund or cancellation rights can apply in particular circumstances, including certain cases involving misrepresentation or failure to fulfill a consumer agreement.
Nothing in these Terms limits rights or remedies that cannot legally be waived under applicable consumer protection legislation.
11. Promotional Codes and Discounts
Promotional codes are subject to the conditions stated with the applicable promotion.
Unless specifically stated otherwise, promotional offers cannot be combined with other promotions or applied retroactively to previously completed purchases.
Promotional codes may have eligibility requirements, product restrictions, minimum purchase requirements, expiration dates or usage limits.
Castelia Card Company reserves the right to cancel or correct a promotion that has been published or configured in error, subject to applicable law.
12. Castelia Coins and Rewards
Castelia Coins are promotional loyalty points offered through the Castelia rewards program.
Castelia Coins are not legal tender, cryptocurrency or stored monetary value and cannot be redeemed for cash.
Coins may be redeemable for eligible rewards, discounts or benefits according to the rewards program terms in effect at the time of redemption.
The earning and redemption structure, available rewards and program features may change over time.
If the Castelia Coins program is modified or discontinued, we will handle outstanding rewards in accordance with applicable law and any specific terms communicated to program members.
Fraudulent activity, manipulation of the rewards system, duplicate accounts created to obtain rewards, or other abuse of the program may result in cancellation of improperly obtained rewards or account restrictions.
13. Customer Accounts
Customers are responsible for maintaining the confidentiality of their account information and credentials.
You are responsible for activity conducted through your account unless unauthorized activity is reported to us.
You agree to provide accurate information and update it when necessary.
We may restrict or terminate accounts used fraudulently, unlawfully or in violation of these Terms.
14. Reviews and User Content
If you submit a review, photograph, comment or other content to Castelia Card Company, you confirm that you have the right to submit that content.
Content must not be unlawful, fraudulent, abusive, defamatory, misleading, infringing or otherwise inappropriate.
We may moderate or remove content where reasonably necessary.
Submitting content does not transfer ownership of your original content to Castelia, but you grant us permission to display and use that content in connection with operating and promoting our store, subject to applicable law.
15. Intellectual Property
The Castelia Card Company name, original logos, graphics, website designs, photographs, promotional materials and other original Castelia content may not be copied, reproduced or commercially exploited without authorization.
Third-party trademarks, product names, characters, card artwork, grading company marks and other intellectual property remain the property of their respective owners.
Castelia Card Company is an independent retailer and is not affiliated with or endorsed by third-party intellectual-property owners merely because their products are sold or referenced on our website.
16. Prohibited Uses
You may not use our website to engage in fraudulent transactions, interfere with the security or operation of the site, introduce malicious code, scrape or misuse protected information, impersonate another person, violate intellectual-property rights, abuse promotional or loyalty programs, or engage in activity prohibited by applicable law.
We may restrict access where reasonably necessary to protect Castelia, our customers or the integrity of our services.
17. Third-Party Services
Certain functionality may be provided by third parties, including Shopify, payment processors, shipping carriers, loyalty providers, review platforms and other service providers.
Those services may be governed by their own terms and privacy practices.
We are not responsible for third-party websites or services that are outside Castelia Card Company’s reasonable control.
18. Privacy
Collection and use of personal information are governed by our Privacy Policy.
By using our website, you acknowledge that information necessary to process transactions, payments, shipping, customer service and other store functions may be processed by Shopify and other service providers used to operate the store.
19. Errors and Omissions
Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping, inventory or availability.
We may correct such information and update the website when errors are identified.
Where an error affects an existing order, we will address the matter reasonably and in accordance with applicable consumer protection law.
20. Disclaimer of Warranties
To the maximum extent permitted by law, our website and services are provided on an “as available” basis.
We do not guarantee that access to the website will always be uninterrupted, error-free or completely secure.
Nothing in this section excludes any statutory warranty, condition, consumer right or other protection that cannot legally be excluded.
21. Limitation of Liability
To the maximum extent permitted by applicable law, Castelia Card Company will not be liable for indirect, incidental, special or consequential losses arising from use of the website or purchase of our products where such liability may lawfully be limited.
Nothing in these Terms limits liability or consumer rights that cannot legally be limited or excluded.
22. Indemnification
To the extent permitted by law, you agree to indemnify Castelia Card Company against losses or claims resulting from your unlawful use of our website, violation of these Terms, infringement of third-party rights, or fraudulent activity.
23. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.
24. Termination
We may suspend or terminate access to our services where a customer materially violates these Terms, engages in fraudulent or abusive activity, or uses the website unlawfully.
Obligations that reasonably survive termination will continue to apply.
25. Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without limiting any mandatory consumer rights that may apply based on the customer’s jurisdiction.
26. Changes to These Terms
We may update these Terms periodically to reflect changes to our business, website, services, legal requirements or policies.
The current version will be posted on our website with the applicable “Last Updated” date.
Continued use of the website after updated Terms take effect constitutes acceptance of the revised Terms to the extent permitted by law.
